Miranda Rights? Public Safety Exception? Why are these things being brought up? Why is it of any consequence that the police are not reciting the Miranda Rights Warning before questioning this man?
Since you have the right to remain silent, whether they tell you about it or not, why would anyone decline that right?

I'm a nobody.....no law school degree and I can't advise anything to anybody, and nobody should listen to anything I say, about anything at all.
I believe this has been brought up in the media in order to give creedence to the notion that you only have the right to remain silent, if the Government GIVES you that right. they are confusing the issue for one reason only.....They are removing your rights in the proper order to ensure success.
The rights afforded to us by our Constitution could be taken away if someone amended it ....HOWEVER; The constitution wasn't written to give us rights....it was written to dictate what the Government could and could not do.
Once looked at from that perspective alot of this debate over the amendments being taken away just seems silly.
But it is actually happening. This discussion about "Miranda Rights can be given later, and we can still convict, because we are questioning himin the interest of ensuring public safety.
?!?!?! EVERY LAW PUT IN PLACE IS THERE TO PROTECT THE PUBLIC.
So, what is the criteria fora law enforcement official to invoke the Public Safety Exception? Any situation that may threaten public saftey....which would include loitering....Yes, That's right....loitering.
